Gun control laws didn’t save Derrion Albert.
The Supreme Court set the stage for a historic ruling on gun rights and the 2nd Amendment by agreeing today to hear a challenge to Chicago's ban on handguns.
At issue is whether state and local gun-control ordinances can be struck down as violating the "right to keep and bear arms" in the 2nd Amendment.
A ruling on the issue, due by next summer, could open the door to legal challenges to various gun control measures in cities and states across the nation.
The case also will decide whether the 2nd Amendment protects a broad constitutional right, similar to the 1st Amendment's right to free speech or the 4th Amendment's protection against unreasonable searches and seizures.
In the past, the Supreme Court had given short shrift to the 2nd Amendment by saying it applied only to national laws and that its aim was to preserve "well-regulated militias."

Tension between gangs of teenagers in Chicago's schools that last year saw the killing of a record 42 young people has reached a peak in the city following the beating to death of a 16-year-old that was captured on camera. The mobile phone footage of the murder of Derrion Albert on Thursday has shocked a city already numbed by high levels of gang violence.
Albert is seen being struck on the head by a boy in a purple shirt who hits him from behind with a long wooden board, thought to be a part of a railway sleeper. Albert falls to the ground, then stands up and is immediately punched in the face by another boy. He slumps to the ground a second time and stays down for more than a minute. Then he struggles onto his feet for a third time, at which point a separate boy strikes him again over the head with a wooden board before a fourth boy stomps on top of his head.
That time he stays down for good.

First Family visits Jefferson and Washington Monuments.
President Barack Obama and his family left the White House Sunday evening for a brief sightseeing tour of two Washington, D.C., monuments.
President Obama was dressed casually for the outing, wearing his customary Chicago White Sox cap, white sneakers and a dark jacket over gray pants.
The Jefferson Memorial was the first stop, and it was reportedly Obama's first visit to the monument since he became president.
Next stop was the Washington Monument where tourists were surprised to see the first family.

First lady Michelle Obama and daughters Malia and Sasha did a little sightseeing when they toured Luray Caverns, a popular tourist attraction in Virginia’s Shenandoah Valley.
The grounds of the caverns feature caves with such geological formations as stalactites and stalagmites.

Hosam Maher Husein Smadi was arrested Thursday after he parked a vehicle laden with government-supplied fake explosives in the underground parking garage of Fountain Place, a 60-story tower in the 1400 block of Ross Avenue at North Field Street, authorities said.
The arrest was part of an FBI sting operation that began after an agent monitoring an online extremist Web site discovered Smadi espousing jihad against the U.S. more than six months ago.
As more undercover Arabic-speaking agents engaged him, Smadi, living illegally in the U.S. in the small town of Italy, about 45 miles south of Dallas, pledged allegiance to Osama bin Laden and expressed a desire to kill Americans, authorities said.
In conversations with agents posing as members of an al-Qaeda sleeper cell, Smadi said he came to the U.S. to wage jihad, or holy war. He told agents he wanted to target military recruitment centers, but eventually settled on financial institutions.
"I want to destroy ... targets ... everything that helps America on its war on Arabs will be targeted," he told undercover agents in May.
Inside the SUV was a fake bomb, designed to appear similar to one used by Timothy McVeigh in the 1995 Oklahoma City bombing. Authorities say Smadi thought he could detonate it with a cellphone. After parking the vehicle, he got into another vehicle with one of the agents, and they drove several blocks away.
An agent offered Smadi earplugs, but he declined, "indicating that he wanted to hear the blast," authorities said. He then dialed the phone, thinking it would trigger the bomb, authorities said. Instead, the agents took him into custody.
Smadi worked at Texas Best Smokehouse in Italy, which is in Ellis County. He lived nearby, alone in a housing development made up of dozens of small, individual dome structures along U.S. Highway 77. One friend described his home as simple; neat, with a surround-sound system, laptop, weight bench, TV and a bed.

Several years, I have flown down to DFW then drove to Italy, Tx to tour the Monolithic Dome Institute. They design super insulated highly energy efficient homes. With proper doors and windows, they are tornado and hurricane resistant. They are California wildfire resistant.

U.S. Supreme Court Justice Ruth Bader Ginsburg was taken to a Washington-area hospital Thursday after she reported feeling faint in the afternoon.
Ginsburg received an iron sucrose infusion to treat an iron deficiency anemia, according to Supreme Court spokeswoman Kathy Arberg. About an hour after receiving the treatment, Ginsburg reported feeling “lightheadedness and fatigue,” Arberg said.
The court’s medical staff monitored Ginsburg and judged her to be in “stable health,” according to Arberg, but decided to transfer her to a local hospital at around 7:45 p.m. as a precaution.
Ginsburg, 76, has suffered other health problems this year. On Feb. 5, 2009, she underwent surgery for pancreatic cancer.

When it comes time to replace Ginsburg, hopefully Obama will appoint someone that realizes the US Supreme Court only duty is to have the laws follow the US constitution. Period.

President Obama has asked the President's Economic Recovery Advisory Board (PERAB) to develop options for tax reform. The members of the tax subcommittee are preparing ideas to be considered by the board and would like to give anyone a chance to have input into the process on this important issue. The deadline for submissions is October 15th, 2009.
Note: The mandate to the PERAB is NOT to recommend a new tax system. They are to consider ideas on tax simplification, better enforcement of tax law, and reforming corporate taxes and to present the pros and cons of potential tax options. They were instructed not to consider options that involve raising taxes on families making less than $250,000 per year. So be mindful of their constraints when submitting ideas.

A 29-year-old man who idolized American-born Taliban soldier John Walker Lindh has been arrested after attempting to detonate what he thought was a bomb inside a van outside a federal courthouse in the Illinois capital of Springfield, officials said Thursday.
Michael C. Finton, also known as Talib Islam, was arrested Wednesday and charged in a criminal complaint with one count of attempting to murder federal officers or employees and trying to detonate a weapon of mass destruction. Federal officials said the case has no connections with the major terrorism investigation under way in Colorado and New York.
"This alleged plot drives home the stark reality that we must avoid complacency and remain ever vigilant to the threats that violent extremists may pose to the public safety," Acting U.S. Attorney Jeffrey B. Lang said.

PUBLIC REPORTING AND OVERSIGHT:

Modifies the current standard for obtaining a National Security Letter to require a statement of facts showing reasonable grounds to believe that the information sought is relevant to an authorized investigation.
INCREASED JUDICIAL REVIEW:
Modifies judicial review of nondisclosure orders associated with 215 orders for tangible things by repealing two provisions added in the 2006 reauthorization: (a) the one-year waiting period before seeking judicial review, and (b) the conclusive presumption favoring nondisclosure.
Imposes a one-year limitation on nondisclosure orders on NSLs and shifts the burden to the government to defend such nondisclosure orders in court.
Requires court approval of minimization procedures for 215 orders for tangible things and for pen/traps.

One of America's most iconic images is Old Glory flying pristinely and proudly over the U.S. Congress. But American flags fluttering this month atop the House office buildings on Capitol Hill where lawmakers and their staffs work each day were tattered, torn and neglected _ hardly worthy of a patriotic portrait.
The flags -- in various states of disrepair -- were captured in photos and videos by The Washington Times as they rippled atop the Rayburn, Cannon and Longworth office buildings where the 435 members of the House of Representatives and their aides go to work each day. Congressional staffers and other passersby didn't even notice the poor state of the Stars and Stripes until a reporter pointed it out.
"If a member of the U.S. Capitol Police observes or is advised by anyone that a flag on a congressional office building needs to be replaced, we obtain a new flag from the Architect of the Capitol and raise it above the respective office building," said Sgt. Kimberly Schneider. "Normal wear can occur quickly for example if a flag in windy conditions is whipped around the flag pole."
When asked for information about when the flags were last changed Ms. Schneider said she could not provide those details.
Damaged flags flying above the Cannon and Longworth office buildings were replaced late last week after they were photographed by the Times. A torn flag continued to fly above the Rayburn building until early this week.

Best way to keep guns out of the hands of criminals is to remove them from law-abiding citizens according to Toronto Police.
Toronto police have seized almost 400 firearms from registered owners in a six-month push aimed at reducing the number of guns on the city's streets.
In March, officers began soliciting registered firearm owners across the city as part of what they call the Safe City Project. Many of those who had to surrender their firearms had either let their registrations lapse, or had stashed their guns improperly under beds or in closets.
The Canadian Firearms Registry stipulates guns must be stored in a secure place.
Targeting people who had registered their guns is a preventative measure, said Toronto Police Chief Bill Blair.
"Legal handgun owners are not dangerous individuals," Blair told reporters at a Tuesday news conference. "But we know from experience that their firearms can become extremely dangerous when they get into the hands of criminals. And so we have undertaken a number of initiatives to reduce the availability of those handguns."

The Obama administration has privately concluded that a cap and trade law would cost American taxpayers up to $200 billion a year, the equivalent of hiking personal income taxes by about 15 percent.
A previously unreleased analysis prepared by the U.S. Department of Treasury says the total in new taxes would be between $100 billion to $200 billion a year. At the upper end of the administration's estimate, the cost per American household would be an extra $1,761 a year.
The FOIA'd document written by Judson Jaffe, who joined the Treasury Department's Office of Environment and Energy in January 2009, says: "Given the administration's proposal to auction all emission allowances, a cap-and-trade program could generate federal receipts on the order of $100 to $200 billion annually." (Obviously, any final cap-and-trade system may be different from what Obama had proposed, and could yield higher or lower taxes.)
Because personal income tax revenues bring in around $1.37 trillion a year, a $200 billion additional tax would be the equivalent of a 15 percent increase a year. A $100 billion additional tax would represent a 7 or 8 percent increase a year.
One odd point: The document written by Jaffee includes this line: "It will raise energy prices and impose annual costs on the order of XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX." The Treasury Department redacted the rest of the sentence with a thick black line.

Zients, who made his career in the private sector by harvesting and sharing best practices across the health care industry and corporate America, said his experience has taught him that “disproportionately, the best ideas come from frontline employees.” Employees can submit their ideas until Oct. 14 using a form on a new Web site. The ideas will be judged by a panel of senior OMB officials.

Because the actions of persons who commit, threaten to commit, or support terrorism continue to pose an unusual and extraordinary threat to the United States, the national emergency declared on September 23, 2001, and the measures adopted on that date to deal with that emergency must continue in effect beyond September 23, 2009. Therefore, in accordance with section 202(d) of the National Emergencies Act (50 U.S.C. 1622(d)), I am continuing for 1 year the national emergency with respect to persons who commit, threaten to commit, or support terrorism.

Ayman al-Zawahiri, al-Qaeda's second man in charge, has warned the US administration that it will be defeated at the hands of the Muslim world.
In a new video released on Tuesday, al-Zawahiri said the government of Barack Obama, the US president, would be brought down by the Mujahid youths of the Muslim Umma (nation).
"God willing, your end will be at the hands of the Muslim nation, so that the world and history will be free of your crimes and lies," he said.
"The important question is, will Obama and his Democrats learn from his predecessor's mistakes or will they go on repeating them until they too leave office in humiliation and disgrace?" Adam Gadahn, also known as Azzam al-Amriki, an American who converted to Islam and joined al-Qaeda, said in the video.
"Unfortunately for the Democrats, and judging by their first seven and a half months at the helm of the sinking American ship, the prognosis doesn't look good."
